Escape Reality Waiver

WAIVER DETAIL

This agreement contains a waiver of important legal rights. Please read carefully.

In consideration of being permitted to participate in a game activity at Escape Reality, defined as a simulated experience in which participants work together to escape a room by solving puzzles and completing mental challenges, I, the undersigned, acknowledge, understand, and agree to the following:

Assumption of Risk & Release of Liability

I ASSUME ANY AND ALL RISKS associated with participation in any game activity conducted by Escape Reality and hereby fully and forever release, waive, discharge, indemnify, and hold harmless Escape Reality from any and all liability, claims, demands, losses, or causes of action arising out of or related to my participation.

This release includes, but is not limited to, risks arising from the negligence, acts, omissions, or carelessness of Escape Reality, as well as from hazardous or defective equipment or property owned, maintained, or controlled by Escape Reality.

For purposes of this Agreement, Escape Reality includes all employees, owners, directors, members, volunteers, representatives, affiliates, insurers, subcontractors, and any other persons acting on its behalf.

Physical & Mental Fitness

I acknowledge that Escape Reality activities may involve excitement, stress, or heightened emotions. I represent and warrant that I am physically and mentally capable of participating and that no medical, physical, or mental condition prevents my safe participation. I voluntarily assume all risks associated with participation.

Personal Property

I understand that Escape Reality is not responsible for loss of or damage to personal property. I release and agree to indemnify Escape Reality for any such loss or damage. I understand that personal belongings should be secured prior to participation.

Minors

If there is a minor participating, I certify that I am giving consent to the minor’s participation and agree, on the minor’s behalf, to all terms and conditions of this Agreement. I have given the minors true information including age. I further certify that I have full legal authority and custody over the minor.

Property Damage & Conduct

I agree to pay for any damage caused by myself or my family due to negligence, recklessness, or intentional actions. I agree not to tamper with, nor allow any minors under my care to tamper with, any safety or security systems, including smoke detectors.

I understand that I may be removed from the premises without refund if I behave unsafely, disruptively, or appear to be under the influence of alcohol or drugs, or if my behavior endangers myself or others.

Indemnification

I agree on behalf of myself and my heirs, executors, administrators, agents, and assigns, to fully and forever release, indemnify, and hold harmless Escape Reality from any and all claims or actions brought by myself or any third party arising from my participation.

Photography & Marketing

I understand that photographs or videos may be taken during or after participation. I grant permission for my likeness to be used for any legitimate business, promotional, or marketing purpose by Escape Reality and its affiliates.

I consent to receive promotional emails and discounts and understand I may unsubscribe at any time.

Governing Law & Venue

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida. Any legal action shall be brought exclusively in the state or federal courts located in Florida.

Special Effects & Content Warning

Some Escape Reality games may include strobe lighting, fog or haze effects, sudden sounds, darkness, or scary content. These experiences may not be suitable for all individuals. Participants with medical conditions such as epilepsy, heart conditions, respiratory issues, anxiety disorders, or other health concerns should not participate.

By signing this Agreement, I acknowledge that I have been informed of these elements and voluntarily choose to participate at my own risk. Escape Reality shall not be liable for any physical, emotional, or psychological reactions resulting from participation.

Electronic Signature

I acknowledge that this Waiver and Release of Liability may be executed electronically and that an electronic or facsimile signature shall be considered legally binding and equivalent to an original signature.

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Acknowledgment

I acknowledge that I have read this Agreement in full, understand its contents, and sign it voluntarily without pressure or duress. I understand that this Agreement is relied upon by Escape Reality and governs my participation.

By providing my email address and phone number, I authorize Escape Reality to email and/or text my after-game report, which may include my team photo.

Perpetual Waiver and Release (Minors)

I have read, understand, and agree to the terms and conditions of the Perpetual Waiver and Release regarding minors for Escape Reality.

Credit Card Authorization

I understand that if I do not process payment myself through the website, I am voluntarily providing my credit card information over the phone for payment processing. I acknowledge that my credit card information will be kept on file and may be charged for any items that are taken from or damaged within the escape room. By signing this waiver, I also waive my right to initiate a credit card chargeback related to this transaction.
